PHOENIX - Arizonar -- Drs. Abram Burgher and Todd Turley have sued Ballard Spahr LLP, a national law firm. In 2015, Ballard Spahr represented the physicians to negotiate the physicians' employment agreements and other medical practice documents. In 2018, the physicians consulted with Ballard Spahr about the enforceability of the documents.
In 2020, Ballard Spahr abandoned their former clients, the physicians Burgher and Turley, and sued them on behalf of the physicians' former practice for allegedly violating the very same non-compete agreements previously negotiated in 2015 and reviewed in 2018 by Ballard Spahr on the physicians' behalf. Ballard Spahr withdrew from the case only after the physicians complained of the massive breach of its ethical duties as a law firm. Despite Ballard Spahr's withdrawal from the case, the case against the physicians continues and largely centers on documents Ballard Spahr negotiated, which Judge Timothy Thomason called "not even close to being clear and understandable."
The physicians allege that the unenforceable and unclear documentation negotiated by Ballard Spahr, which were later used to sue the physicians, led the physicians to be sued by their former practice, costing them hundreds of thousands of dollars in attorney's fees, mental stress, time being involved in a lawsuit, and prevented them from obtaining financing for their new practice. Ballard Spahr is seeking to have the physicians' lawsuit against them dismissed in a proceeding currently before Judge Thomason.

Abram Burgher MD and Todd Turley MD both completed their residency in Anesthesiology and a fellowship in Pain Management at Mayo Clinic in Rochester, MN.
